Please note: Design Dance reserves the right to change, update, modify, or alter their policies and procedures throughout at any point. Design Dance will make all necessary efforts to inform the Independent Contractor of any changes, updates, or modifications to the policies and procedures in order to ensure compliance.

Independent Contractors

As of the 2019-2020 academic year, all instructors with Design Dance are Independent Contractors

An independent contractor is a person, business, or corporation that provides goods or services under a written contract or a verbal agreement. Unlike employees, independent contractors do not work regularly for an employer but work as required.

A business may pay an independent contractor and an employee for the same or similar work, but there are important legal differences between the two. For the employee, the company withholds income tax, Social Security, and Medicare from wages paid. For the independent contractor, the company does not withhold taxes. If you are an independent contractor, you are self-employed. To find out what your tax obligations are, visit the Self-Employed Tax Center. You may also do some research regarding potential tax write-offs regarding your teaching practice.


Professional Conduct

Instructors represent The Brainchild Collective and Design Dance to all parents, partners, and students in a professional and helpful way.


  1. At minimum, instructors adhere to the standards of the instructor’s assigned tier. Instructors should always strive for excellence, regardless of tier.

  2. Instructors adhere to additional policies and procedures outlined by the partner and/or school location, including proper student oversight procedures, pick-up and drop-off procedures, and disciplinary conduct measures.

  3. Instructors respect invoicing procedures and deadlines as established by the Brainchild Collective.

  4. Instructors are required to respond to emails from Brainchild Collective management within 1-2 business days and texts/calls within 24 hours. Prompt communication is vital as a Teaching Artist.

  5. Instructors should direct family questions to The Brainchild Collective administrative staff as needed by either emailing us OR giving families our contact information

      1. This includes any logistical questions such as days off, session dates, session cost, etc. 

  6. Instructors refuse to take payments from parents and should instead direct parents to The Brainchild Collective management team.

    • All payments must be made through our website or over the phone.  

  7. Instructors are not authorized to schedule any type of outing with students (program related or otherwise) without clearance from Brainchild Collective  management.


Social Media Policy

Although we all enjoy free speech rights guaranteed by the First Amendment to the United States Constitution, certain types of communication, typically by virtue of their subject-matter connection to a Brainchild Collective program, may have ramifications for the author or subject.

  • Independent Contractors are expected to silence or turn off their phones during class, except when the phone is directly used in classroom activities. 

    • Such activities include: music, timers for freeze dance, recording a routine, etc. 

  • Any student photos or videos taken during or obtained from Brainchild Collective program classrooms must be submitted to Brainchild Collective  staff. Photos and videos may then be shared on the company Facebook page and family networks. 

    • Brainchild Collective management may reach out directly to request media from classes.  

  • Independent Contractors may not post pictures, text messages, e-mails, or other material taken in, obtained from, or used in conjunction with Brainchild Collective program classrooms on their personal platforms. 

    • Independent Contracts may share posts from the Brainchild Collective platforms to personal channels when appropriate.

  • Independent Contractors may not use images, resources, or emails relating to students, families, partner organizations, classrooms or classroom activities connected with a Brainchild Collective program for personal gain, promotion, or profit. 

  • Contractors teaching for Brainchild Collective programs are reminded that any internet information is ultimately accessible to the world. To avoid jeopardizing professional effectiveness, Independent Contractors are encouraged to familiarize themselves with the privacy policies, settings, and protections on any social networking websites to which they choose to subscribe.


Dress Code

Keep it appropriate; make sure you can move!

When teaching for Design Dance or another movement-based program, instructors are required to dress in clothing appropriate for moving freely and working with children.

When teaching any career development program, instructors can dress in casual but professional clothing. 

At Family Observation Days, community/school events, or Professional Development workshops, Design Dance administration asks that you wear a Design Dance branded shirt. All instructors will have access to 1 free Design Dance shirt at the commencement of their contractor agreement.


Loyalty

Under the conditions outlined below, instructors can accept teaching positions with other dance education companies while contracted by The Brainchild Collective.

The Brainchild Collective reserves the right to protect its customer relationships, business practices, and client base throughout the Chicago area. 

Instructors may not advertise for competing dance education programs.

Instructors are prohibited from using contacts, resources, or information received during your contract with The Brainchild Collective to create, advertise or contribute to a competing dance education program. again with the purpose of protecting Design Dance's customer relations, business practices, and client base throughout the Chicago area.

If a student requests or needs advice on alternative dance education programs, The Brainchild Collective and the instructor shall act together in advising and giving guidance. 


Suspension & Termination

Independent Contractors may be suspended or discharged for good cause as shall be determined in the exclusive discretion of The Brainchild Collective.

It is specifically understood that good cause for discharge shall include but not be limited to:

  1. Inadequacy of teaching

  2. Misconduct

  3. Neglect of duty

  4. Physical or mental incapacity

  5. Actions involving moral turpitude

  6. Violation of the terms of this agreement

  7. Any conduct not keeping with the rules and regulations of The Brainchild Collective.
